Code, Local Government § 21–624","heading":"","body":"(a) This section applies only in Montgomery County.\n(b) Subject to subsections (c)(1) and (d) of this section, the County Council\nof Montgomery County shall impose an ad valorem tax on all property assessed for\ntax purposes in the county, including property in any municipality in the county.\n(c) (1) Except for the City of Takoma Park, the ad valorem tax may not\nexceed:\n(i) 0.4 cent per $100 of the assessed value of real property; or\n(ii) 1 cent per $100 of the assessed value of personal property\nand operating real property described in § 8–109(c) of the Tax – Property Article.\n(2) The tax shall be in an amount necessary to pay for the\nmaintenance of:\n(i) stormwater management systems in the part of the\nsanitary district in Montgomery County that were previously maintained by the\nCommission; and\n(ii) on application of a municipality, any stormwater\nmanagement system previously maintained by the municipality.\n(d) (1) If a municipality decides to maintain all existing stormwater\nmanagement systems in its boundaries, the municipality shall notify the county\ncouncil of its intent to maintain the stormwater management systems before the date\non which the county council adopts its annual budget.\n(2) If the conditions set forth in paragraph (1) of this subsection are\nmet, all assessable properties in the municipality shall be exempt from the tax\nimposed under this section.\n(e) (1) The county shall maintain every interest in stormwater\neasements, structures, and other properties in the county, whether or not established\nby plat, that were transferred by deed to the county.\n(2) The Commission and any municipality in the county shall allow\nthe county to enter and exit over any fee, leasehold, easement, or right–of–way of the\nCommission or municipality to maintain any stormwater easement, structure, or\nother property.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=21-624","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"5d99bfedb435b93074a2d9edf4569fd6a48b2a29e542f42b3ec382fe65af09cc","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-21-623","next":"us-md/md.-code-local-government-21-625"},"notice":"GroundRules: Original legal text.
