Code, Local Government § 21–638","heading":"","body":"(a) Montgomery County, Prince George’s County, the City of Bowie, the City\nof Takoma Park, and any person or municipality may not adopt a stormwater\nmanagement plan, system, or design in these jurisdictions, including a capital\nimprovement program for stormwater management, unless:\n(1) the stormwater management plan or design is in accordance with\nthe 6–year capital improvement program of the jurisdiction responsible for\nstormwater management in the affected area and is approved by that jurisdiction; or\n(2) the plan, system, or design is intended to protect an individual’s\nhome and has no adverse impact on other properties or stormwater management\nsystems.\n(b) (1) (i) If Montgomery County, Prince George’s County, the City of\nBowie, or the City of Takoma Park prepares a stormwater management plan, system,\nor design, or if a stormwater management plan, system, or design has been submitted\nto Montgomery County, Prince George’s County, the City of Bowie, or the City of\nTakoma Park, the city or county shall submit a copy of the plan, system, or design to\nthe Commission.\n(ii) After the submission, the Commission shall have a\nspecified, reasonable time to review and comment on the plan, system, or design to\nthe city or county to indicate any conflict in the plan, system, or design with the\nexisting or planned water supply or sanitary sewer systems of the Commission.\n(iii) The stormwater management system or design approved\nby Montgomery County, Prince George’s County, the City of Bowie, or the City of\nTakoma Park shall be consistent with the Commission’s comments.\n(2) (i) When the Commission receives a copy of a plan from the\nCity of Bowie, the Commission promptly shall provide a copy to the County Council\nand County Executive of Prince George’s County for review and comment.\n(ii) When the Commission receives a copy of a plan from the\nCity of Takoma Park, the Commission promptly shall provide a copy to the County\nCouncil and County Executive of Montgomery County for review and comment.\n(3) When Prince George’s County receives a plan that provides for\ndrainage into a storm drain or stormwater management facility of the City of Bowie\nor onto any easement of the City of Bowie, the county promptly shall provide a copy\nof the plan to the City of Bowie for review and comment.\n(c) (1) If the Commission or Prince George’s County, after reviewing a\nplan submitted by the City of Bowie, advises the city that the Commission or county\nfinds that construction in accordance with the plan will cause stormwater runoff\nproblems in the maintenance of existing facilities or construction and maintenance of\nplanned facilities, the city may not authorize construction to begin until the matter\nis resolved.\n(2) If the Commission or Montgomery County, after reviewing a plan\nsubmitted by the City of Takoma Park, advises the city that the Commission or\ncounty finds that construction in accordance with the plan will cause stormwater\nrunoff problems in the maintenance of existing facilities or construction and\nmaintenance of planned facilities, the city may not authorize construction to begin\nuntil the matter is resolved.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=21-638","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"dd077c18e16c7a5bc40811ed782e91172a5d5a2fd5de705ea6cf6799e07bc496","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-21-637","next":"us-md/md.-code-local-government-21-641"},"notice":"GroundRules: Original legal text.
