Code, Local Government § 21–641","heading":"","body":"(a) All property of the Commission that the Commission and the applicable\ncounty mutually determine to be used primarily for stormwater management is\ndeemed transferred effective July 1, 1987, to that county as provided in this section.\n(b) All property of the Commission that the Commission and the City of\nTakoma Park mutually determine to be used primarily for stormwater management\nis deemed transferred effective July 1, 1990, to the City of Takoma Park as provided\nin this section.\n(c) (1) The Commission shall execute instruments of transfer as\nnecessary to evidence the transfers.\n(2) All real and personal property, including all fees, leaseholds,\neasements, rights–of–way, buildings, fixtures, systems, and equipment, owned or\nheld by the Commission for the primary purpose of stormwater management is\ntransferred to the county in which the property is located or affixed or to the City of\nTakoma Park if the property is located in or affixed to the City of Takoma Park.\n(3) All tangible and intangible personal property, including all\nequipment, construction materials, fees, fees–in–lieu, contributions, reserve funds,\nsinking funds, contracts, agreements, claims, demands, and actions, owned or held\nby the Commission for the primary purpose of stormwater management is\ntransferred to the county in which is located the real property to which the personal\nproperty relates or to the City of Takoma Park if the real property to which the\npersonal property relates is located in the City of Takoma Park or, if unrelated to\nspecific property, is transferred in proportion to the real property acreage transferred\nto each county or to the City of Takoma Park under this section.\n(d) Notwithstanding this section, the Commission shall retain sufficient\nfunds to pay for debt service accruing before October 1, 1987, on outstanding bonds\nissued by the Commission for stormwater management and the undepreciated cost of\nthe moveable assets transferred.\n(e) (1) The transfer of property under this section does not impair the\nrights of holders of bonds issued by the Commission for stormwater management or\nthe responsibility of the Commission for the repayment of the bonds or the\nresponsibility of the counties to impose taxes for or otherwise guarantee the\nrepayment of the bonds.\n(2) The City of Takoma Park is not responsible for payment to the\nCommission for debt service on any bonds issued by the Commission outstanding on\nJune 30, 1990.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=21-641","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"15018fe826f2961cffe8791bb7a228f2d11bb400845f99b599f92e13e1c16e0a","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-21-638","next":"us-md/md.-code-local-government-21-644"},"notice":"GroundRules: Original legal text.
