Code, Local Government § 25–902","heading":"","body":"(a) Notwithstanding § 25–901 of this subtitle, on a written petition for\ndissolution by any member of the most recently elected or appointed board of directors\nof a watershed association in Washington County considered inactive as provided in\nsubsection (b) of this section, the County Commissioners of Washington County\npromptly shall:\n(1) consider all available information to determine the current\noperating status and foreseeable operating potential of the watershed association;\nand\n(2) approve or deny the petition for dissolution.\n(b) For the purpose of this section, a watershed association in Washington\nCounty is considered inactive if for at least 5 years the watershed association has not\ncomplied substantially with a majority of the ordinary operating procedures required\nunder this title, including:\n(1) the maintenance of ongoing and current information in the\nwatershed file at the office of the clerk of the county;\n(2) election of a board of directors and officers of the board;\n(3) an annual meeting of landowners in the area affected by the\nwatershed association;\n(4) the submission of an annual report by the board of directors to\nthe clerk of the county;\n(5) the development, approval, filing, execution, or maintenance of a\nwork plan applicable to property owned by the watershed association; and\n(6) the submission and regular updating of the watershed\nassociation’s easement record in the office of the clerk of the circuit court in the\napplicable county.\n(c) (1) This subsection applies only after the County Commissioners of\nWashington County approve a petition for dissolution under this section.\n(2) If any balance remains in the county treasury to the credit of the\ndissolved watershed association, the county commissioners shall:\n(i) satisfy all outstanding debts of the watershed association;\nand\n(ii) retain any remaining balance.\n(3) The county commissioners shall provide for the transfer of any\ninterest in real property held by the watershed association to the county in which the\nproperty is located.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=25-902","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"8a84330c567616dd12e7303aa14c7b3ac693b95cd280d83876d6bf55e799581d","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-25-901","next":"us-md/md.-code-local-government-25-1001"},"notice":"GroundRules: Original legal text.
