Code, Local Government § 26–1003","heading":"","body":"(a) If a drainage project established under this title crosses a railroad right–\nof–way at the intersection of the right–of–way with a natural watercourse or\ndepression through which water flows at periods of high water, the railroad company\nshall:\n(1) construct, build, and maintain any necessary new bridge or\nculvert; or\n(2) enlarge, strengthen, reconstruct, or replace any existing bridge or\nculvert.\n(b) The expense to the railroad under subsection (a) of this section shall be:\n(1) considered an element of damage to the railroad company by the\nboard of viewers; and\n(2) shown as a damage in the report of the board of viewers.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=26-1003","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"55fe2fe8ba0a170d8e6ec8f7b9e8dc8806710c009fb7eaac51a5b1c39a30c8e5","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-26-1002","next":"us-md/md.-code-local-government-26-1101"},"notice":"GroundRules: Original legal text.
