Code, Local Government § 26–302","heading":"","body":"(a) Within 30 days after the approval of the petition and report, the county\ncommissioners or county council shall call a meeting of the landowners to elect a\nboard of managers.\n(b) (1) At least 10 days before the meeting, the county commissioners or\ncounty council shall post a notice of the meeting at four public places in the area or\nvicinity of the area of the drainage association.\n(2) The notice shall state the time, place, and purpose of the meeting.\n(c) (1) Each landowner is entitled to vote in the election of the board of\nmanagers until the board of viewers report is approved by the county commissioners\nor county council.\n(2) When the report of the board of viewers is approved, each\nlandowner is entitled to vote according to the special assessment on the landowner\nshown in the report as follows:\n(i) for any special assessment not exceeding $15, one vote;\n(ii) for any special assessment more than $15 and not\nexceeding $35, two votes;\n(iii) for any special assessment more than $35 and not\nexceeding $60, three votes;\n(iv) for any special assessment more than $60 and not\nexceeding $100, four votes;\n(v) for any special assessment more than $100, one additional\nvote for each $50 in excess of $100, plus one additional vote for any remaining part\nless than $50.\n(3) Any landowner may vote by written proxy signed by the\nlandowner.\n(d) A quorum consists of the number of landowners who are entitled to cast\na majority of all the votes as provided in subsection (c) of this section.\n(e) On proof that notice has been given as required in subsection (b) of this\nsection, if a quorum is not obtained, the county commissioners or county council shall\nappoint the managers.\n(f) The board of managers elected under subsection (a) of this section shall\ndetermine by a random drawing the managers who:\n(1) serve until the date of the first regular annual meeting;\n(2) serve until the date of the first regular annual meeting and for 1\nyear thereafter; or\n(3) serve until the date of the first regular annual meeting and for 2\nyears thereafter.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=26-302","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"a366e0137c9897f5ee2dc4bbf2487c173cb8d666327a535a11c40ddd71d22976","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-26-301","next":"us-md/md.-code-local-government-26-303"},"notice":"GroundRules: Original legal text.
