Code, Local Government § 26–403","heading":"","body":"(a) On completion of the plan, or on the acceptance of a previously\ncompleted plan, the board of managers shall call a meeting of the landowners to vote\non the adoption of the plan for submission to the county commissioners or county\ncouncil.\n(b) (1) At least 10 days before the meeting, the board of managers shall:\n(i) post a notice of the meeting in four public places in the area\nor vicinity of the area of the drainage association; and\n(ii) mail a notice to each landowner.\n(2) The notice shall state the time, place, and purpose of the meeting.\n(c) At the meeting required under subsection (a) of this section:\n(1) each landowner is entitled to one vote; and\n(2) any landowner may vote by proxy if the proxy is dated, signed by\nthe individual entitled to vote, and witnessed by at least one individual.\n(d) (1) The board of managers shall determine whether to submit the\nplan to the county commissioners or county council for review and approval.\n(2) In making the determination, the board of managers shall\nconsider:\n(i) the vote of each landowner;\n(ii) the probable apportionment of benefits to each landowner\nbased on acreage;\n(iii) the location of the drainage project; and\n(iv) the extent of the benefits to the voter’s land by the drainage\nproject.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=26-403","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"5cd78febb631d473c3ecd7f8c376c9e04b4c75b088ead6cb7798e9437975037a","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-26-402","next":"us-md/md.-code-local-government-26-404"},"notice":"GroundRules: Original legal text.
