Code, Local Government § 27–302","heading":"","body":"(a) The board of viewers:\n(1) shall make a careful and thorough examination of the land\ndescribed in the petition and of other land if necessary, to locate properly any\nimprovement that is petitioned for, along the route described in the petition or any\nother route that is more practicable or feasible;\n(2) shall ensure that the land of any person who is seeking to be\nincluded in the drainage district has been included in the drainage district; and\n(3) may conduct surveys to:\n(i) determine the boundaries and elevations of the parts of the\ndistrict; and\n(ii) enable the board of viewers to form a tentative plan for\ndevelopment.\n(b) (1) The board of viewers shall make and return to the designated\nofficer a written report that states whether:\n(i) the proposed drainage is practicable;\n(ii) the proposed drainage will benefit the public health or any\npublic highway or be conducive to the general welfare of the community;\n(iii) the proposed drainage project will benefit the land in\nquestion sufficiently to warrant the probable expenditure; and\n(iv) all the land that will be benefited is included in the\nproposed drainage district.\n(2) The report shall be available for inspection in an office of the\ndesignated officer within 30 days after the date on which the designated officer\nreceives the report, unless the county commissioners or county council extend the\ntime period for providing the report.\n(c) The report shall include a map of the proposed drainage district that:\n(1) shows the location of the ditch or other improvement to be\nconstructed with an estimate of the cost of the improvement;\n(2) shows the land that will be affected by the improvement,\nincluding the name of each landowner, if the name of the landowner can be obtained;\nand\n(3) provides any other information collected by the board of viewers\nthat supports the board’s findings.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=27-302","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"2b2f6afb76a966f1f8aab00c579286fb3fa43d30f04857c29f4204f6a4509351","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-27-301","next":"us-md/md.-code-local-government-27-303"},"notice":"GroundRules: Original legal text.
