Code, Local Government § 27–310","heading":"","body":"(a) Any landowner may appear at the hearing in person or by counsel and\nobject in writing to the report of the board of viewers.\n(b) The county commissioners or county council shall:\n(1) review the report of the board of viewers and any objection filed\nto the report; and\n(2) make any change that is necessary to treat each landowner in the\ndrainage district equitably.\n(c) (1) If the county commissioners or the county council finds that the\ncost of construction and the amount of damages assessed do not exceed the benefit\nthat will accrue to the affected land, the county commissioners or county council shall\nconfirm the report of the board of viewers and declare the drainage district to be\nestablished.\n(2) If the county commissioners or the county council finds that the\ncost of construction and the amount of damages assessed exceed the benefit that will\naccrue to the affected land, the county commissioners or county council shall dismiss\nthe proceedings at the cost of the petitioners, and any surety on the bond filed by the\npetitioners shall be liable for the costs.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=27-310","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"64e5052a286c5d760264457dcd573a6ce7751849fa9aeea09e792c86ea18d6ee","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-27-309","next":"us-md/md.-code-local-government-27-401"},"notice":"GroundRules: Original legal text.
