Code, Local Government § 27–705","heading":"","body":"(a) (1) The board of drainage commissioners shall give notice of a\nproposal to issue bonds by:\n(i) publication for 3 weeks in a newspaper of general\ncirculation in the county where any part of the drainage district is located;\n(ii) posting a notice at the door of the courthouse in the county\nwhere any part of the drainage district is located; and\n(iii) posting a notice at five conspicuous places in the vicinity of\nthe drainage district.\n(2) The notice shall include:\n(i) the proposal to issue bonds to pay for the total cost of the\ndrainage project;\n(ii) the amount of bonds to be issued;\n(iii) the interest rate for the bonds; and\n(iv) the date when the bonds are payable.\n(b) (1) A landowner that does not want to pay interest on the bonds may\npay to the county tax collector, within 15 days after the publication of the notice in\nsubsection (a) of this section, the full amount due for the landowner, as provided in\nthe classification sheet and the certificate of the board of drainage commissioners\nshowing the total cost of the drainage project.\n(2) If the landowner pays the full amount, the landowner is relieved\nfrom liability for the drainage project.\n(3) The landowner shall continue to be liable for any future\nassessment for maintenance or for any increased assessment authorized under law.\n(c) (1) At the expiration of the 3 weeks after the publication of the notice\nin subsection (a) of this section, the board of drainage commissioners may issue bonds\nof the drainage district in an amount equal to the total cost of the drainage project\nless any amount that has been paid to the county tax collector, including an amount\nsufficient to pay interest on the bond issue for the 3 years after the date of issue.\n(2) All bonds issued under this section:\n(i) shall bear interest;\n(ii) shall be payable semiannually;\n(iii) shall be paid in 10 equal installments, with the first\ninstallment of principal maturing 3 years after the issue, and one installment for each\nsucceeding year for 9 additional years;\n(iv) shall be numbered by the board of drainage commissioners;\n(v) shall be recorded in the drainage record; and\n(vi) may not be sold for a price less than par.\n(3) The board of drainage commissioners shall use the proceeds of the\nbonds to pay:\n(i) for the work as it progresses;\n(ii) the interest on the bonds issued for the 3 years after the\ndate of issue; and\n(iii) the other expenses of the drainage district provided under\nthis title.\n(d) (1) The proceeds from the sale of bonds under this section shall be for\nthe exclusive use of the drainage district specified on the bonds.\n(2) The drainage record shall list the land in the drainage district on\nwhich the assessment has not been paid in full.\n(e) (1) If an installment of principal or interest on the bonds is not paid\nat the time and in the manner due and the default continues for 6 months, the holder\nof the bond in default has a right of action against the drainage district or the board\nof drainage commissioners.\n(2) If an action is brought, the court may issue a writ of mandamus\nagainst the drainage district and its officers, including the county tax collector, that\ndirects the imposition of a special assessment against landowners in default in an\namount necessary to meet unpaid installments of principal and interest and the costs\nof the action.\n(3) The holder of any bond in default may:\n(i) pursue any other remedy authorized by law; and\n(ii) bring suit against any officer on the official bond of the\nofficer for failing to perform a duty required under this title.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=27-705","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"7b2b0e4993bec1153ab560ec7c7947aa1f3e35a8e7df10f3604dda935df89239","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-27-704","next":"us-md/md.-code-local-government-27-706"},"notice":"GroundRules: Original legal text.
