Code, Local Government § 27–801","heading":"","body":"(a) A landowner that has been assessed under this title for the cost to\nconstruct a ditch, drain, or watercourse may use the ditch, drain, or watercourse as\nan outlet for lateral drains from the assessed land.\n(b) The owner of the assessed land may petition the county commissioners\nor county council if:\n(1) the assessed land is separated from a ditch, drain, or watercourse\nby the land of another; and\n(2) the owner of the assessed land and the other landowner do not\nagree on the terms and conditions under which the owner of the assessed land may\nenter the property of the other landowner and construct a lateral drain or ditch.\n(c) A lateral ditch constructed under this section shall be:\n(1) part of the drainage system;\n(2) under the control of the board of drainage commissioners; and\n(3) maintained by the board of drainage commissioners as provided\nunder this title.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=27-801","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"e0f7f2ecfa6e74fc667e8ffa2de0b3b54c206abc82ad42dd70ba8e155df322f4","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-27-710","next":"us-md/md.-code-local-government-27-901"},"notice":"GroundRules: Original legal text.
