Code, Local Government § 29–108","heading":"","body":"(a) This section supersedes any contrary provision of the Public Information\nAct and the St. Mary’s County Open Meetings Act.\n(b) (1) Subject to paragraph (2) of this subsection:\n(i) all activities of the Commission that relate to an\nalternative dispute resolution, a grievance, or a complaint of discrimination shall be\nconducted in confidence and without publicity; and\n(ii) the Commission may meet in closed session when dealing\nwith an alternative dispute resolution, a grievance, or a complaint of discrimination.\n(2) If all parties involved in an alternative dispute resolution, a\ngrievance, or a complaint of discrimination consent in writing, the activities of the\nCommission related to the alternative dispute resolution, grievance, or complaint of\ndiscrimination may be conducted publicly.\n(3) Except as provided under § 29–107 of this title, the Commission\nshall hold confidential all information concerning an alternative dispute resolution,\na grievance, or a complaint of discrimination, including the identities of the parties\ninvolved.\n(4) The Commission shall hold confidential any information and\nrecords obtained by a predecessor county body that was authorized to perform a\nfunction similar to that of the Commission before July 1, 1997.\n(c) (1) Information related to the activities or involvement of the\nCommission in an alternative dispute resolution, a grievance, or a complaint of\ndiscrimination may not be admitted as evidence in any administrative proceeding or\nlitigation.\n(2) The records of the Commission may not be discovered in any\nadministrative proceeding or litigation.\n(d) (1) Except as provided under § 29–107 of this title and paragraph (2)\nof this subsection, information or records related to the activities or involvement of\nthe Commission in an alternative dispute resolution, a grievance, or a complaint of\ndiscrimination are not subject to public inspection under the Maryland Public\nInformation Act.\n(2) Statistical information may be made available for public\ninspection under § 4–501(e) of the General Provisions Article.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=29-108","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"c52003f206859a0a643208b976952a4bd56437e29c2fd6a8c1253d9d621ce6da","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-29-107","next":"us-md/md.-code-local-government-29-109"},"notice":"GroundRules: Original legal text.
