Code, Local Government § 30–108","heading":"","body":"(a) (1) Subject to paragraph (2) of this subsection:\n(i) the amount of benefit payable under § 30–107(a) of this\ntitle is $10,000; and\n(ii) the amount of benefit payable under § 30–107(b) of this\ntitle is $500.\n(2) The Board may prospectively and uniformly establish by\nresolution an amount of benefit payable under this title that is greater than the\namount specified in this subsection.\n(3) The benefit provided for under this title shall be in addition to all\nother benefits provided by law or by voluntary action of any person.\n(b) (1) On the death of an officer or a civilian employee of the\nDepartment, the benefit provided for under this title is payable to the following\nindividuals:\n(i) the surviving spouse;\n(ii) if there is no surviving spouse, to the minor children, in\nequal shares;\n(iii) if there is no surviving spouse or minor children, to the\ndependent parents, in equal shares; or\n(iv) if there is no surviving spouse, minor child, or dependent\nparent, to any other dependents or the estate of the officer or employee.\n(2) Any benefit paid under paragraph (1)(iv) of this subsection shall:\n(i) not exceed the maximum benefit provided in subsection (a)\nof this section; and\n(ii) be paid in proportions determined by the Board.\n(3) (i) Any benefit payable to a minor shall be made to the minor’s\nlegal guardian in the State.\n(ii) If a benefit is payable to a minor who does not have a legal\nguardian in the State, the benefit is payable on behalf of the minor to a person\ndetermined by the Board under conditions set by the Board.\n(4) A beneficiary’s eligibility is not affected by whether the deceased\nofficer or civilian employee paid into the Fund.\n(c) The benefit provided for under this title is not subject to:\n(1) execution, garnishment, attachment, or any other process; and\n(2) assignment until the benefits are paid to the beneficiary.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=30-108","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"e13038d09f6450720ff796b08a5756c340fc875d13757282838c15a8402beeee","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-30-107","next":"us-md/md.-code-local-government-31-101"},"notice":"GroundRules: Original legal text.
