Code, Local Government § 4–209","heading":"","body":"(a) Except as expressly or necessarily modified by this subtitle, a\nreferendum shall be conducted generally according to the procedures and practices\nfor regular countywide elections.\n(b) (1) On the day and during the hours specified for the referendum, the\nquestion of incorporation under the proposed municipal charter shall be submitted to\nthe registered voters of the area proposed to be incorporated.\n(2) The county board of elections shall arrange for and conduct the\nreferendum.\n(3) The wording specified by the county commissioners or county\ncouncil in the resolution authorizing a referendum on the question of the proposed\nincorporation shall be placed on the ballots used at the referendum.\n(c) Promptly after the canvass is complete, the county board of elections\nshall certify the results to the county commissioners or county council.\n(d) Within 10 days after receiving a certification of the vote on the\nreferendum from the county board of elections:\n(1) if a majority of those who voted on the question voted in favor of\nincorporation under the proposed municipal charter:\n(i) the county commissioners or county council publicly shall\nso proclaim; and\n(ii) on the 30th day after the public proclamation, the area\nproposed to be incorporated shall become a municipality operating under the\nmunicipal charter; or\n(2) if less than a majority of those who voted on the question voted in\nfavor of incorporation under the proposed municipal charter:\n(i) the county commissioners or county council publicly shall\nso proclaim; and\n(ii) the proclamation shall state that the proposed\nincorporation is not approved.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=4-209","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"91f2d78b410f87de2ddf4c2f131fb436aa7c1980f6e9d50a9d27fc75dbf9330f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-4-208","next":"us-md/md.-code-local-government-4-210"},"notice":"GroundRules: Original legal text.
