Code, Local Government § 4–314","heading":"","body":"(a) If the following conditions are satisfied, the Executive Director of the\nDepartment of Legislative Services promptly shall certify all the facts to the\nSecretary of State:\n(1) a municipality fails for 3 consecutive years to file with the\nDepartment of Legislative Services a comprehensive statement of financial condition\nas required under § 16–103 of this article;\n(2) the Executive Director of the Department of Legislative Services\nhas reasonable cause to believe the municipality is no longer actively operating as a\nmunicipality under its charter; and\n(3) the Legislative Auditor certifies that the municipality has no\ndebts or obligations outstanding and unpaid.\n(b) (1) On receiving a certification under subsection (a) of this section,\nthe Secretary of State shall issue a public proclamation declaring that the municipal\ncharter is repealed under this section.\n(2) The Secretary of State shall file copies of the proclamation with:\n(i) the clerk of the Supreme Court of Maryland;\n(ii) the clerk of the circuit court of the county in which the\nmunicipality is located; and\n(iii) the Department of Legislative Services.\n(c) The repeal of the municipal charter is effective on the first day of the\nmonth after a proclamation is issued under subsection (b) of this section.\n(d) On and after the effective date of the repeal:\n(1) the former municipality may not be treated as a municipality; and\n(2) the repealed municipal charter may not be included in any later\nedition or codification of public local laws of the county in which the municipality was\nlocated or of the State.\n(e) If the assets and liabilities of the former municipality have not been\ndisposed of before a municipal charter is repealed, after the charter is repealed the\ncounty commissioners or county council of the county in which the municipality is\nlocated shall:\n(1) succeed to full ownership, title, and control of the assets of the\nmunicipality; and\n(2) liquidate the debt of the municipality as provided in § 4–313 of\nthis subtitle.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=4-314","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"7cb1580f524b6f47357aebf433f7a1714d0097315ccca581c2f4afa6da109018","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-4-313","next":"us-md/md.-code-local-government-4-401"},"notice":"GroundRules: Original legal text.
