Code, Local Government § 4–401","heading":"","body":"(a) Subject to subsections (b) and (c) of this section, the legislative body of a\nmunicipality may enlarge its boundaries by annexation as provided in this subtitle.\n(b) The power of annexation applies only to land that:\n(1) is contiguous and adjoining to the existing boundaries of the\nmunicipality; and\n(2) does not create an unincorporated area that is bounded on all\nsides by:\n(i) real property presently in the boundaries of the\nmunicipality;\n(ii) real property proposed to be in the boundaries of the\nmunicipality as a result of the proposed annexation; or\n(iii) any combination of real property described in item (i) or (ii)\nof this item.\n(c) A municipality may not annex land that is in another municipality.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=4-401","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"7952da55262b5e970db77b44447dcc37dc5a8b6ed707afb7e0cdf263bd14f7ab","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-4-314","next":"us-md/md.-code-local-government-4-402"},"notice":"GroundRules: Original legal text.
