Code, Local Government § 4–412","heading":"","body":"(a) The governing body of a municipality, by ordinance, resolution, or\nregulation, may provide for conducting and tabulating the results of a referendum\nheld under this subtitle.\n(b) (1) The annexation resolution shall be submitted to:\n(i) a referendum of the qualified voters of the municipality if\nthe petition for referendum was presented by the residents of the municipality;\n(ii) subject to § 4–413 of this subtitle, a referendum of the\nregistered voters who are residents in the area to be annexed if the petition for\nreferendum was presented by the residents of the area to be annexed; or\n(iii) separate referendums of the voters specified in items (i)\nand (ii) of this paragraph if a petition for referendum was presented by the residents\nof the municipality and the residents in the area to be annexed.\n(2) A petition for referendum presented by the governing body of a\ncounty shall be acted on in the same manner as a petition for referendum presented\nby the residents of the area to be annexed.\n(c) The ballot shall:\n(1) contain a summary of the annexation resolution; and\n(2) provide for the voter to indicate a choice for or against the\nannexation resolution.\n(d) (1) If only one petition for a referendum is filed and if a majority of\nthe persons voting on the annexation resolution vote for the resolution, the resolution\ntakes effect on the 14th day after the referendum.\n(2) (i) If a referendum is conducted for both the residents of the\nmunicipality and the residents in the area to be annexed, the votes cast for the two\nreferendums shall be tabulated separately to show the votes cast in the municipality\nand the area to be annexed.\n(ii) If in both referendums a majority of the persons voting on\nthe annexation resolution vote for the resolution, the resolution takes effect on the\n14th day after the referendum.\n(iii) If two referendums are held, the annexation resolution is\nvoid unless a majority in both referendums vote for the resolution.\n(e) The municipality shall pay for a referendum held under this subtitle.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=4-412","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"dae61aeed6affb1f559dfe4e3814fc5a280564554277545a3de678b5ed81ccbd","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-4-411","next":"us-md/md.-code-local-government-4-413"},"notice":"GroundRules: Original legal text.
