Code, Local Government § 4–416","heading":"","body":"(a) (1) Notwithstanding § 4–104(f) of this title, if an area is annexed to a\nmunicipality that has planning and zoning authority at the time of annexation, the\nmunicipality shall have exclusive jurisdiction over planning, subdivision control, and\nzoning in the area annexed.\n(2) Paragraph (1) of this subsection does not grant any planning or\nzoning power or subdivision control to a municipality that is not authorized to\nexercise planning or zoning power or subdivision control at the time of annexation.\n(b) Without the express approval of the county commissioners or county\ncouncil of the county in which the municipality is located, for 5 years after an\nannexation by a municipality, the municipality may not allow development of the\nannexed land for land uses substantially different than the authorized use, or at a\nsubstantially higher density, not exceeding 50%, than could be granted for the\nproposed development, in accordance with the zoning classification of the county\napplicable at the time of the annexation.\n(c) Notwithstanding § 4–204 of the Land Use Article and if the county\nexpressly approves, the municipality may place the annexed land in a zoning\nclassification that allows a land use or density different from the land use or density\nspecified in the zoning classification of the county or agency with planning and zoning\njurisdiction over the land prior to its annexation applicable at the time of the\nannexation.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=4-416","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"1e323d96930f9d7897696fd983c329c51cbdf5e2ccb6279582701a196d642c30","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-4-415","next":"us-md/md.-code-local-government-4-501"},"notice":"GroundRules: Original legal text.
