Code, Local Government § 5–102","heading":"","body":"(a) This section does not affect any agreement existing before October 1,\n1997, between a county and a municipality concerning the imposition of development\nimpact fees.\n(b) If a county imposes a development impact fee on new residential\nconstruction to finance the costs of school construction, a municipality shall assist the\ncounty by:\n(1) collecting and remitting the fee for new residential construction\nin the municipality to the county; or\n(2) requiring the fee to be paid to the county in accordance with the\ncounty development impact fee law or ordinance.\n(c) The application of any impact fee paid under subsection (b) of this\nsection shall have a rational nexus to the project for which the fee is assessed.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=5-102","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"4c602c0d1fba6b6360b6a23627e9aac9509241416b6663397be61300f7b6afa1","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-5-101","next":"us-md/md.-code-local-government-5-103"},"notice":"GroundRules: Original legal text.
