Code, Local Government § 5–206","heading":"","body":"(a) (1) A municipality may establish a merit system in connection with\nthe appointment of any municipal official or employee not elected or appointed under\nthe Maryland Constitution, public general law, or public local law.\n(2) In accordance with § 4–303 of the State Personnel and Pensions\nArticle, a municipality may request and use the facilities of the Department of Budget\nand Management in the administration of a merit system established under\nparagraph (1) of this subsection.\n(b) A municipality may set the compensation of municipal officers and\nemployees.\n(c) A municipality may provide for:\n(1) a retirement or pension system or a group insurance plan for its\nofficers and employees; or\n(2) including its officers and employees in any retirement or pension\nsystem operated by or in conjunction with the State, on the terms and conditions set\nforth in State law.\n(d) (1) Subject to paragraph (2) of this subsection, a municipality may\nprovide for the removal or temporary suspension from office of an appointed\nmunicipal officer for:\n(i) inefficiency;\n(ii) malfeasance;\n(iii) misfeasance;\n(iv) nonfeasance;\n(v) misconduct in office; or\n(vi) insubordination.\n(2) Before removing or suspending any officer, the municipality shall\nnotify the officer and conduct a hearing.\n(3) A municipality may provide for filling the vacancy caused by the\nremoval or suspension.\n(e) Subject to its municipal charter, a municipality may provide for special\nelections for municipal purposes at times and places determined by the municipality.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=5-206","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"ab7b49021810182d70a8fe6268e9b0a18ac5f9d24d9bd91ab85ce936f3ccc274","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-5-205","next":"us-md/md.-code-local-government-5-207"},"notice":"GroundRules: Original legal text.
