Code, Local Government § 5–214","heading":"","body":"(a) Section 18–301 of this article applies to the use of federal or State\nfinancial assistance for commercial or industrial redevelopment projects.\n(b) (1) In this subsection, “authority” means a commercial district\nmanagement authority.\n(2) A municipality may establish an authority for any commercial\ndistrict in the municipality.\n(3) For each authority established, a municipality shall:\n(i) specify the membership, organization, jurisdiction, and\ngeographical limits of the authority;\n(ii) provide financing for the authority through fees that may\nbe charged to, or taxes that may be imposed against, any business subject to the\nauthority’s jurisdiction; and\n(iii) specify the purposes of the authority, including:\n1. promotion;\n2. marketing; or\n3. the provision of security, maintenance, or amenities\nin the district.\n(4) An authority may not:\n(i) exercise the power of eminent domain;\n(ii) purchase, sell, construct, or lease, as lessor, office or retail\nspace; or\n(iii) except as otherwise authorized by law, engage in\ncompetition with the private sector.\n(5) Any fee or tax imposed under this subsection shall be used only\nfor the purposes stated in this subsection and may not revert to the general fund of\nthe municipality.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=5-214","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"a0d0b81fce721b42d7576528739017ce828630a95079129915a0c39672669f33","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-5-213","next":"us-md/md.-code-local-government-5-215"},"notice":"GroundRules: Original legal text.
