Code, Local Government § 5–216","heading":"","body":"(a) A municipality may establish and maintain any park, garden,\nplayground, or recreational facility that the municipality determines is for the benefit\nof the health and welfare of the municipality and its residents.\n(b) (1) Subject to paragraph (2) of this subsection, a municipality may\nacquire by gift, grant, bequest, or devise and hold property absolutely or in trust for:\n(i) parks or gardens;\n(ii) the erection of statues, monuments, buildings, or\nstructures; or\n(iii) any public use.\n(2) The municipality shall acquire, hold, or use property under this\nsubsection on the terms and conditions required by the grantor or donor and accepted\nby the municipality.\n(3) The municipality shall provide for the administration of any\nproperty accepted by the municipality under this subsection.\n(4) Subject to the terms and conditions of the original grant, the\nmunicipality may convey any property accepted by the municipality under this\nsubsection if the municipality determines that the property is no longer needed for\npublic purposes.\n(c) A municipality may establish, maintain, and support a municipal band\nor musical organization.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=5-216","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"463f56337a34e9250beefae02e4adb559354ecd5242d5cc8b5832b769b4919c8","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-5-215","next":"us-md/md.-code-local-government-5-217"},"notice":"GroundRules: Original legal text.
