Code, Local Government § 5–302","heading":"","body":"(a) (1) The governing body of a municipality that provides residential\nstreet service may make an agreement with a private community that qualifies under\nparagraph (2) of this subsection concerning:\n(i) the provision of residential street service to the private\ncommunity by the municipality; or\n(ii) instead of providing residential street service, the\nreimbursement to the private community of an amount not to exceed the cost that\nthe municipality would incur to provide residential street service.\n(2) The governing body of a municipality may make an agreement\nunder this section with a private community that:\n(i) lies wholly or partly in the municipality; and\n(ii) has at least one–quarter mile of roadway.\n(b) An agreement entered into under this section may require the private\ncommunity to:\n(1) pay any insurance rider that the municipality requires to enable\nvehicles owned or contracted by the municipality to operate on a roadway in the\nprivate community; and\n(2) regarding a roadway in the private community that is to be used\nto provide residential street service:\n(i) allow the roadway to be dedicated to public use; and\n(ii) unless maintenance of the roadway is provided by the\nmunicipality, maintain the roadway at a level of service satisfactory to the\nmunicipality.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=5-302","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"61e5df978cc819d706a1cfeeb77010a1b86423319030bee4ca2386f043061951","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-5-301","next":"us-md/md.-code-local-government-6-101"},"notice":"GroundRules: Original legal text.
