Code, Local Government § 6–103","heading":"","body":"(a) Any official authorized by the legislative body of a municipality to act as\nan enforcement officer may serve a citation on a person:\n(1) who the official believes is committing or has committed a\nmunicipal infraction; or\n(2) on the basis of an affidavit that:\n(i) cites the facts of the alleged infraction; and\n(ii) is submitted to a designated official of the municipality.\n(b) (1) The citation shall be served on the defendant:\n(i) in accordance with Maryland Rule 3–121; or\n(ii) for real property–related violations, if an affidavit is made\nthat good faith efforts to serve the defendant under Maryland Rule 3–121(a) have not\nsucceeded, by:\n1. regular mail to the defendant’s last known address;\nand\n2. posting the citation at the property where the\nmunicipal infraction has occurred or is occurring and, if located in the municipality,\nat the defendant’s residence or place of business.\n(2) The enforcement officer shall retain a copy of the citation.\n(c) The citation shall contain:\n(1) the enforcement officer’s certification:\n(i) attesting to the truth of the matter set forth in the citation;\nor\n(ii) that the citation is based on an affidavit;\n(2) the name and address of the defendant;\n(3) the nature of the municipal infraction;\n(4) the location and time that the municipal infraction occurred;\n(5) the amount of the fine assessed;\n(6) the manner, location, and time in which the fine may be paid to\nthe municipality;\n(7) notice of the defendant’s right to elect to stand trial; and\n(8) notice of the effect of failing to pay the fine or demand a trial\nwithin the required time.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=6-103","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"3c1b9b8705f2a66b3228f4ec3a40413759fd8338b88c52f01bfca74d0d1bf1ff","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-6-102","next":"us-md/md.-code-local-government-6-104"},"notice":"GroundRules: Original legal text.
