Code, Local Government § 6–109","heading":"","body":"(a) In a municipal infraction proceeding:\n(1) the District Court shall confirm that the defendant has received\na copy of and understands the charges;\n(2) the defendant may enter a plea of guilty or not guilty;\n(3) the District Court shall apply the evidentiary standards provided\nby law or rule for the trial of a civil case;\n(4) the defendant may:\n(i) cross–examine witnesses;\n(ii) produce evidence or witnesses on the defendant’s own\nbehalf;\n(iii) testify; and\n(iv) be represented by counsel of the defendant’s choice and at\nthe defendant’s expense; and\n(5) the municipality has the burden to prove by clear and convincing\nevidence that the defendant has committed the infraction.\n(b) The District Court may:\n(1) enter a verdict of guilty or not guilty; or\n(2) before entering a verdict, place the defendant on probation.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=6-109","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"11cb291ae3f6519f5bad68b4b7b132cba4c192278c16394125d5193817a2370f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-6-108.1","next":"us-md/md.-code-local-government-6-110"},"notice":"GroundRules: Original legal text.
