Code, Local Government § 9–405","heading":"","body":"(a) This section applies only to code counties and commission counties.\n(b) This section does not apply to a county that has adopted local ethics laws\nunder §§ 5–808 and 5–809 of the General Provisions Article if the local ethics laws\nhave been approved by the State Ethics Commission.\n(c) During a county commissioner’s term of office, the county commissioner\nmay not:\n(1) possess or acquire any share or interest in, or have or participate\nin, either directly or indirectly, any benefit, profit, or compensation of any agreement\nor contract entered into with any party by the county commissioners as county\ncommissioners; or\n(2) accept, possess, or acquire any claim, or any share or interest in\nany claim, on or against the county of which the individual is a commissioner if the\nclaim has been or will be passed on and approved by the county commissioners.\n(d) (1) If a county commissioner violates the provisions of this section,\nthe county commissioner is subject to prosecution.\n(2) A county commissioner who is convicted under this section shall\nforfeit:\n(i) the office; and\n(ii) the county commissioner’s share or interest in the\nagreement, contract, or claim in which the county commissioner was involved.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=9-405","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"cfb4046ca86fd9ceea3457bbf3569ba09502a2a01619f84cb0e99ce0d48b381a","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-9-404","next":"us-md/md.-code-local-government-9-406"},"notice":"GroundRules: Original legal text.
