Code, Local Government § 9–512","heading":"","body":"(a) A public agency meeting or a staff meeting may be conducted in a closed\nsession only:\n(1) to consider or discuss the assignment, promotion, resignation,\nsalary, demotion, dismissal, reprimand, or appointment of a member of a public\nagency or employee, unless the individual, as a matter of public record, makes a\nwritten request for an open session;\n(2) to discuss strategy in collective bargaining or litigation;\n(3) to engage in collective bargaining;\n(4) to discuss the distribution of police forces to cope with public\nsafety emergencies;\n(5) to discuss cost estimates for capital projects to be subsequently\nplaced through the bidding process;\n(6) to hold preliminary discussions concerning the purchase or\ndisposition of real property;\n(7) when State law or federal regulation prohibits a meeting open to\nthe public;\n(8) to meet a condition for anonymity of a donor contained in a gift or\nbequest to the public agency;\n(9) when secrecy is necessary to prevent the premature disclosure of\nthe format or content of examinations or the disclosure of results of examinations as\nrelated to individual students;\n(10) if the meeting is conducted by the County Board of Education or\nits staff to:\n(i) consider the discipline of a student, unless the parent,\nguardian, or student requests an open session of the County Board of Education; or\n(ii) discuss specific students, families, or personnel and the\ndisclosure of the discussions could prove detrimental or harmful to those individuals;\n(11) to consider the investment of public funds;\n(12) to consult with counsel to obtain legal advice; or\n(13) to discuss cybersecurity, if the public body determines that public\ndiscussion would constitute a risk to:\n(i) security assessments or deployments relating to\ninformation resources technology;\n(ii) network security information, including information that\nis:\n1. related to passwords, personal identification\nnumbers, access codes, encryption, or other components of the security system of a\ngovernmental entity;\n2. collected, assembled, or maintained by or for a\ngovernmental entity to prevent, detect, or investigate criminal activity; or\n3. related to an assessment, made by or for a\ngovernmental entity or maintained by a governmental entity, of the vulnerability of\na network to criminal activity; or\n(iii) deployments or implementation of security personnel,\ncritical infrastructure, or security devices.\n(b) (1) A closed session shall be announced in advance at a meeting that\nis open to the public.\n(2) An announcement of a closed session shall include the nature of\nthe business of the closed session.\n(3) The closed session shall be limited to the matters described in\nsubsection (a) of this section.\n(c) The minutes of the next open session shall include the justification for\nholding the closed session, the names of those in attendance, and the times the\nmeeting begins and ends.\n(d) An ordinance, resolution, rule, regulation, or decision may not be finally\nadopted at a closed session.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=9-512","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"61d70240e0af6df94cd1ef793af3ad52c24b9eac65fac2aa82ed24ad83f8a645","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-9-511","next":"us-md/md.-code-local-government-9-513"},"notice":"GroundRules: Original legal text.
