Code, Natural Resources § 5–9D–01","heading":"","body":"(a) In this subtitle the following words have the meanings indicated.\n(b) “Board” means the Greenspace Equity Advisory Board.\n(c) (1) “Community greenspace” means a community space that enhances the public health and livability of an overburdened community or an underserved community.\n(2) “Community greenspace” includes:\n(i) A community garden;\n(ii) A community gathering open space area;\n(iii) A community woodland;\n(iv) A green network;\n(v) A park;\n(vi) A trail; and\n(vii) An urban farm.\n(d) “Eligible applicant” means:\n(1) A land trust or nongovernmental organization located or working in an overburdened community or an underserved community where a project is proposed to be implemented; or\n(2) A county or municipality.\n(e) “Green network” means a system of greenspaces that are interconnected by linear corridors that facilitate the movement of people and wildlife.\n(f) “Land acquisition” means:\n(1) The fee simple acquisition of real property; or\n(2) The acquisition of a perpetual conservation easement.\n(g) “Land trust” means an organization that:\n(1) Is a qualified organization under § 170(h)(3) of the Internal Revenue Code and any regulations adopted under that section;\n(2) Has executed a cooperative agreement with the Maryland Environmental Trust; or\n(3) Is an affordable housing land trust as defined in § 14–501 of the Real Property Article.\n(h) “Overburdened community” has the meaning stated in § 1–701 of the Environment Article.\n(i) “Program” means the Greenspace Equity Program.\n(j) (1) “Stewardship” means activities undertaken on a project to:\n(i) Develop a property for public use; and\n(ii) Improve the conservation value of the property.\n(2) “Stewardship” does not include the operating expenses of a recipient of a grant under the Program.\n(k) “Underserved community” has the meaning stated in § 1–701 of the Environment Article.","path":["Article - Natural Resources"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gnr\u0026section=5-9D-01","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:08Z","sha256":"e8d5d1b313249be033d8b60f499cb9fefd5942106fafe6cc30cf6c75b400ed9b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-natural-resources-5-9c-03","next":"us-md/md.-code-natural-resources-5-9d-02"},"notice":"GroundRules: Original legal text.
