Code, Natural Resources § 5–9D–04","heading":"","body":"(a) (1) Subject to paragraph (2) of this subsection, land acquired by a grant awarded under the Program may not be converted from outdoor public recreation or open space to any other use without the prior written approval of:\n(i) The Secretary;\n(ii) The Secretary of Budget and Management; and\n(iii) The Secretary of Planning.\n(2) A conversion of land under paragraph (1) of this subsection may be approved only after the grant recipient replaces the land being converted with land that has:\n(i) An area that is at least equivalent in size with the land being converted;\n(ii) A recreation or open space value equivalent with that of the land being converted; and\n(iii) An appraised value equivalent to or greater than that of the land being converted.\n(b) Land developed or improved by a grant awarded under the Program must be operated and maintained for public use by the grant recipient for at least 15 years from the project completion date.","path":["Article - Natural Resources"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gnr\u0026section=5-9D-04","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:08Z","sha256":"22a85324a79705022ea606ca2d19c69f7b8b36c8188a4013174abc9fe4a75683","source_id":"us-md","stale":false,"prev":"us-md/md.-code-natural-resources-5-9d-03","next":"us-md/md.-code-natural-resources-5-9d-05"},"notice":"GroundRules: Original legal text.
