Code, Public Safety § 12–1202","heading":"","body":"(a) This subtitle does not alter or abrogate the authority of:\n(1) the State Fire Prevention Commission to enforce the Electrical Code under Subtitle 6 of this title;\n(2) the Public Service Commission to enforce the Energy Code defined under the Energy Conservation Building Standards Act, Title 7, Subtitle 4 of the Public Utilities Article; or\n(3) the Maryland Department of Health to:\n(i) enforce the Standards for the design and construction, including additions, alterations, or repairs, of public swimming pools; or\n(ii) regulate the operation and maintenance of swimming pools and spas.\n(b) This subtitle does not alter or abrogate any zoning power or related authority of a county or municipal corporation.\n(c) This subtitle does not allow or encourage the State to initiate or assume an independent role in the administration and enforcement of the Standards for a swimming pool or spa that is not owned or operated by the State.","path":["Article - Public Safety"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gps\u0026section=12-1202","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:18Z","sha256":"179109e70dc5e33900aba41d0a87547ee3f6c45987cbe481d203a67d9a11c44f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-public-safety-12-1201","next":"us-md/md.-code-public-safety-12-1203"},"notice":"GroundRules: Original legal text.
