Code, Public Safety § 2–310","heading":"","body":"(a) Unless sufficient facilities are not available, the managing official of a correctional facility shall receive and confine an individual arrested by a police employee without warrant or on warrant from a county.\n(b) (1) An individual confined under subsection (a) of this section:\n(i) is deemed to be in the custody of the Department; and\n(ii) shall remain confined until a court of competent jurisdiction issues a warrant or other process, or the individual is returned to the county.\n(2) Before the issuance of a warrant or process, an individual confined under subsection (a) of this section may be released only to and on written order of a police employee.\n(c) (1) This section does not abridge the right of an individual to be taken before a judicial officer of the State promptly after arrest.\n(2) The managing official of a correctional facility in which an individual is confined under this section, shall notify the State’s Attorney immediately if the individual is confined for more than 12 hours.","path":["Article - Public Safety"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gps\u0026section=2-310","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:18Z","sha256":"2b0e7a9164e64ae406ff6e1f52174964576452d471db42902c6f3ac9ee195701","source_id":"us-md","stale":false,"prev":"us-md/md.-code-public-safety-2-309","next":"us-md/md.-code-public-safety-2-311"},"notice":"GroundRules: Original legal text.
