Code, Public Safety § 2–415","heading":"","body":"(a) (1) Retirement shall occur in accordance with the State Personnel and Pensions Article.\n(2) Except for the Secretary, retirement is mandatory as provided in § 24-401(c) of the State Personnel and Pensions Article.\n(b) (1) The Secretary may apply for disability retirement on behalf of a police employee in accordance with § 29-103 of the State Personnel and Pensions Article.\n(2) This subsection does not prevent a police employee from exercising the individual’s rights under § 21-111 of the State Personnel and Pensions Article.\n(c) (1) Notwithstanding any other provision of law, a police employee, on retirement in good standing, may keep or acquire the handgun issued by the State to that police employee if:\n(i) the police employee reimburses the Department for the replacement value of the handgun; and\n(ii) the Secretary authorizes the transaction.\n(2) The Secretary shall adopt regulations necessary to carry out this subsection.","path":["Article - Public Safety"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gps\u0026section=2-415","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:18Z","sha256":"63e036cacfaa665e146ddb687197d51445c1f9bab44962edb77c9691cbb1e8bb","source_id":"us-md","stale":false,"prev":"us-md/md.-code-public-safety-2-414","next":"us-md/md.-code-public-safety-2-416"},"notice":"GroundRules: Original legal text.
