Code, Public Utilities § 11–208","heading":"","body":"(a) The Commission may impose on a person who violates this subtitle or a regulation adopted in accordance with this subtitle a civil penalty that does not exceed the maximum penalties provided in 49 U.S.C. Chapter 601 (Hazardous Liquid Pipeline Safety Act).\n(b) Each day a violation continues is a separate violation under this section.\n(c) To determine the amount of a penalty imposed under this section, the Commission shall consider:\n(1) the nature, circumstances, and gravity of the violation;\n(2) with respect to the violator:\n(i) the degree of culpability;\n(ii) any history of prior violations;\n(iii) the ability to pay;\n(iv) any effect on the ability to continue doing business; and\n(v) good faith in attempting to comply; and\n(3) other matters that justice requires.","path":["Article - Public Utilities"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gpu\u0026section=11-208","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:28Z","sha256":"17cea5d5e6fd2d58ec3978a81e4955984fe180de6844f7ea9a1a440f964d3986","source_id":"us-md","stale":false,"prev":"us-md/md.-code-public-utilities-11-207","next":"us-md/md.-code-public-utilities-12-101"},"notice":"GroundRules: Original legal text.
