Code, Public Utilities § 17–104","heading":"","body":"(a) A commissioner may be removed before the completion of the commissioner’s term:\n(1) in Montgomery County:\n(i) by the County Executive with the approval of a majority of the members of the County Council; or\n(ii) unless the County Executive disapproves the resolution in writing within 30 days after its adoption, by resolution of a majority of the members of the County Council; and\n(2) in Prince George’s County, by the County Executive with the approval of a majority of the members of the County Council.\n(b) (1) Unless a hearing is waived in writing by the commissioner designated for removal, before any removal under this section, a public hearing shall be held:\n(i) in Montgomery County, by the body initiating the removal proceeding; or\n(ii) in Prince George’s County, by the County Council.\n(2) The commissioner shall be given an opportunity at the hearing to present a defense.","path":["Article - Public Utilities"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gpu\u0026section=17-104","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:28Z","sha256":"0aa8f89d580f90d09e89db99bf8a96166fb2b8a0daf2cce13195f5e42ee4db1d","source_id":"us-md","stale":false,"prev":"us-md/md.-code-public-utilities-17-103","next":"us-md/md.-code-public-utilities-17-105"},"notice":"GroundRules: Original legal text.
