Code, Real Property § 11–111.5","heading":"","body":"(a) (1) In this section the following words have the meanings indicated.\n(2) “Composting” means the controlled aerobic biological decomposition of organic waste material.\n(3) “Composting facility” has the meaning stated in § 9–1701 of the Environment Article.\n(b) A recorded covenant or restriction, a provision in a declaration, or a provision in the bylaws or rules of a condominium may not prohibit or unreasonably restrict a unit owner from contracting with a private entity to collect organic waste materials from the unit owner for composting at a composting facility.\n(c) A recorded covenant or restriction, a provision in a declaration, or a provision in the bylaws or rules of a condominium that unreasonably impedes the ability of a private entity to access the common elements for the purpose of collecting organic waste materials from a unit owner shall be interpreted as a restriction on the unit owner’s right to contract for private composting services under subsection (b) of this section.","path":["Article - Real Property"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=grp\u0026section=11-111.5","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:38Z","sha256":"f23332b146ac74352bbafe98c35104092d760bcff8d98dfe3f6fe92099a48da0","source_id":"us-md","stale":false,"prev":"us-md/md.-code-real-property-11-111.4","next":"us-md/md.-code-real-property-11-112"},"notice":"GroundRules: Original legal text.
