Code, Real Property § 8–405","heading":"","body":"(a) If a tenant under a lease dies intestate and without next of kin, the landlord may bring an action for summary ejectment under § 8–401 of this subtitle against the tenant named in the lease notwithstanding the tenant’s death.\n(b) The landlord shall certify to the court in the written complaint required under § 8–401(b)(1) of this subtitle that, to the best of the landlord’s knowledge, the tenant is deceased, intestate, and without next of kin.\n(c) Property or income from property that a landlord holds for a deceased, intestate tenant without next of kin shall be presumed abandoned in accordance with Title 17 of the Commercial Law Article.","path":["Article - Real Property"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=grp\u0026section=8-405","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:38Z","sha256":"1a441f651089fe1d92427005335111b6ed41690e71310dd69329a21e7bd5c92b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-real-property-8-404","next":"us-md/md.-code-real-property-8-406"},"notice":"GroundRules: Original legal text.
