Code, Real Property § 8–5A–01","heading":"","body":"(a) In this subtitle the following words have the meanings indicated.\n(b) “Abuse” has the meaning stated in § 4–501(b) of the Family Law Article.\n(c) “Legal occupant” means an occupant who resides on the premises with the actual knowledge and permission of the landlord.\n(d) “Offender” means a person who commits an act of abuse.\n(e) “Peace order” means an enforceable final peace order.\n(f) “Protective order” means an enforceable final protective order.\n(g) “Qualified third party” means:\n(1) A physician who is authorized to practice medicine under the Health Occupations Article;\n(2) A psychologist who is authorized to practice psychology under the Health Occupations Article;\n(3) A social worker or caseworker of any public or private health or social services agency or provider; or\n(4) An advocate from a domestic violence or sexual assault prevention or assistance program.\n(h) “Report by a qualified third party” means a report based on information received by a qualified third party while acting in a professional capacity that:\n(1) Indicates that the tenant or a legal occupant is seeking assistance as a result of an act of abuse;\n(2) Includes the following elements:\n(i) The name of the tenant or legal occupant;\n(ii) A statement that the tenant or legal occupant is a victim of abuse;\n(iii) The date, time, location, and a brief description of the incident;\n(iv) The name and physical description of the alleged offender, if known;\n(v) The name and address of the employer of the qualified third party;\n(vi) The licensing entity and license number of the qualified third party, if the qualified third party is required to be licensed; and\n(vii) The signature of the qualified third party, under seal of a notary public; and\n(3) Is signed and acknowledged by the tenant or legal occupant under penalty of perjury.","path":["Article - Real Property"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=grp\u0026section=8-5A-01","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:38Z","sha256":"4d40b2c0f9d72adf133d058d946b9c674c4ab520c7fabd44d29ffa8d859658a1","source_id":"us-md","stale":false,"prev":"us-md/md.-code-real-property-8-503","next":"us-md/md.-code-real-property-8-5a-02"},"notice":"GroundRules: Original legal text.
