Code, State Finance and Procurement § 12–104","heading":"","body":"(a) Except as provided in subsection (b) of this section, the Board may modify or waive any requirement under this Division II for a procurement contract or a class of procurement contracts that is to be performed entirely outside the United States, or any lease of real property outside this State, to the extent that:\n(1) the purposes stated in § 11–201(a) of this article are fostered;\n(2) the circumstances require the modification or waiver; and\n(3) foreign or out–of–state contractors are expected to be involved in the procurement.\n(b) The Board may not modify or waive the following requirements:\n(1) § 14–404 of this article (“Coal in heating systems”);\n(2) Title 16, Subtitle 2 of this article (“Offenses Subject to Debarment”); and\n(3) Title 17 of this article (“Special Provisions –– State and Local Subdivisions”).","path":["Article - State Finance and Procurement"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf\u0026section=12-104","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:48Z","sha256":"38d7a34636ac4b4aee1cf3108fc3b812078f256c4427e3dabc810f1aa9d5d787","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-finance-and-procurement-12-103","next":"us-md/md.-code-state-finance-and-procurement-12-105"},"notice":"GroundRules: Original legal text.
