Code, State Finance and Procurement § 12–202","heading":"","body":"(a) This section does not apply to capital expenditures:\n(1) for public school construction under Title 5, Subtitle 3 of the Education Article; or\n(2) by the Department of Transportation or the Maryland Transportation Authority, in connection with State roads, bridges, or highways.\n(b) Before execution, a contract for a capital expenditure other than in connection with a State correctional facility, St. Mary’s College of Maryland, Morgan State University, or the University System of Maryland shall be:\n(1) reviewed by the Secretary of General Services; and\n(2) except as provided in § 12-203 of this subtitle and § 13-108 of this article, after that review, approved by the Board.\n(c) Before execution, a contract for a capital expenditure in connection with a State correctional facility shall be:\n(1) reviewed by the Secretary of Public Safety and Correctional Services; and\n(2) except as provided in § 12-203 of this subtitle, after that review, approved by the Board.\n(d) Before execution, a contract for a capital expenditure in connection with the University System of Maryland shall be:\n(1) subject to the provisions of Title 4, Subtitle 4 of this article;\n(2) approved by the Board of Regents of the University System of Maryland; and\n(3) approved by the Board of Public Works.\n(e) Before execution, a contract for a capital expenditure in connection with St. Mary’s College of Maryland shall be:\n(1) subject to the provisions of Title 4, Subtitle 4 of this article;\n(2) approved by the Board of Trustees of St. Mary’s College of Maryland; and\n(3) approved by the Board of Public Works.\n(f) Before execution, a contract for a capital expenditure in connection with Morgan State University shall be:\n(1) subject to the provisions of Title 4, Subtitle 4 of this article;\n(2) approved by the Board of Regents of Morgan State University; and\n(3) approved by the Board of Public Works.\n(g) The Board shall supervise the expenditure of any money that the General Assembly appropriates for:\n(1) buildings;\n(2) equipment;\n(3) new construction; or\n(4) any other capital expenditure.","path":["Article - State Finance and Procurement"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf\u0026section=12-202","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:48Z","sha256":"0dffa0f81627ae7977c3b327ac23d242eedf5fc8e9e59f2d5fc4577ace542cf4","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-finance-and-procurement-12-201","next":"us-md/md.-code-state-finance-and-procurement-12-203"},"notice":"GroundRules: Original legal text.
