Code, State Finance and Procurement § 14–206","heading":"","body":"(a) In this section, “percentage preference” means the percent of the lowest responsive bid submitted by a responsible bidder who is not a small business by which a responsive bid by a small business may:\n(1) exceed the lowest bid; and\n(2) be awarded a procurement contract under this subtitle.\n(b) Subject to the approval of the Board, each unit:\n(1) shall establish a percentage preference, not to exceed 8%, for each industry as follows:\n(i) a base percentage preference not to exceed 5% for all small businesses; and\n(ii) two additional preferences to the percentage preference set forth in item (i) of this paragraph as follows:\n1. 2% for veteran–owned small businesses; and\n2. 3% for disabled veteran–owned small businesses; and\n(2) may vary the percentage preference determined in item (1)(i) of this subsection among industries to account for their particular characteristics.","path":["Article - State Finance and Procurement"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf\u0026section=14-206","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:48Z","sha256":"46c6f166c18e6682b280a362823764ae6d7cc1798da1734e428f7a2f0bb0b4ab","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-finance-and-procurement-14-205","next":"us-md/md.-code-state-finance-and-procurement-14-207"},"notice":"GroundRules: Original legal text.
