Code, State Finance and Procurement § 14–501","heading":"","body":"(a) In this subtitle the following words have the meanings indicated.\n(b) “Certification agency” has the meaning stated in § 14–301 of this title.\n(c) “Economically disadvantaged individual” has the meaning stated in § 14–301 of this title.\n(d) “Small business” means:\n(1) a certified minority business enterprise, as defined in § 14–301 of this title, that meets the criteria specified under item (3) of this subsection;\n(2) a veteran–owned small business enterprise, as defined in § 14–601 of this title, that meets the criteria specified under item (3) of this subsection; or\n(3) a business, other than a broker, that meets the following criteria:\n(i) the business is independently owned and operated;\n(ii) the business is not a subsidiary of another business;\n(iii) the business is not dominant in its field of operation; and\n(iv) 1. A. the wholesale operations of the business did not employ more than 50 persons in its most recently completed 3 fiscal years;\nB. the retail operations of the business did not employ more than 25 persons in its most recently completed 3 fiscal years;\nC. the manufacturing operations of the business did not employ more than 100 persons in its most recently completed 3 fiscal years;\nD. the service operations of the business did not employ more than 100 persons in its most recently completed 3 fiscal years;\nE. the construction operations of the business did not employ more than 50 persons in its most recently completed 3 fiscal years; and\nF. the architectural and engineering services of the business did not employ more than 100 persons in its most recently completed 3 fiscal years; or\n2. A. the gross sales of the wholesale operations of the business did not exceed an average of $4,000,000 in its most recently completed 3 fiscal years;\nB. the gross sales of the retail operations of the business did not exceed an average of $3,000,000 in its most recently completed 3 fiscal years;\nC. the gross sales of the manufacturing operations of the business did not exceed an average of $2,000,000 in its most recently completed 3 fiscal years;\nD. the gross sales of the service operations of the business did not exceed an average of $10,000,000 in its most recently completed 3 fiscal years;\nE. the gross sales of the construction operations of the business did not exceed an average of $7,000,000 in its most recently completed 3 fiscal years; and\nF. the gross sales of the architectural and engineering services of the business did not exceed an average of $4,500,000 in its most recently completed 3 fiscal years.\n(e) “Small business reserve” means those procurements that are limited to responses from small businesses under § 14–502(c) of this subtitle.","path":["Article - State Finance and Procurement"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf\u0026section=14-501","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:48Z","sha256":"e56b76cd9e2e6368b64e0e222ebc15cab5d0d5c787af347bceaac9c9c3be28bc","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-finance-and-procurement-14-418","next":"us-md/md.-code-state-finance-and-procurement-14-502"},"notice":"GroundRules: Original legal text.
