Code, State Finance and Procurement § 5–606","heading":"","body":"(a) The Plan may not be used to deny:\n(1) a State–issued permit; or\n(2) State funding:\n(i) mandated by statute or regulation; or\n(ii) provided for in the State operating budget or capital budget.\n(b) The Plan does not:\n(1) supersede any State statute or regulation;\n(2) supersede any local ordinance or regulation;\n(3) affect the delegation of planning and zoning powers granted by the State to local jurisdictions under Division II, Title 9, Subtitles 2 or 3, Title 10, or Title 11 of the Local Government Article and Division I of the Land Use Article; or\n(4) overturn or prevent a decision of a local jurisdiction to fund a project.\n(c) The Plan may not require a local government to change or alter a local ordinance, regulation, or comprehensive plan.","path":["Article - State Finance and Procurement"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf\u0026section=5-606","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:48Z","sha256":"ae7b7445a27e92a9c942b7bd920873cb2a0ec1bdea03c9da58875ddc4f3e3b6f","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-finance-and-procurement-5-605","next":"us-md/md.-code-state-finance-and-procurement-5-608"},"notice":"GroundRules: Original legal text.
