Code, State Finance and Procurement § 7–238","heading":"","body":"(a) (1) In this section the following words have the meanings indicated.\n(2) “Capital project” means a project for which funds are spent for:\n(i) the construction, reconstruction, or rehabilitation of a transportation facility, as defined in § 3-101(l) of the Transportation Article; or\n(ii) capital equipment as defined by the Secretary of Transportation.\n(3) “Major capital project” has the meaning stated in § 2-103.1 of the Transportation Article.\n(4) “Modal administration” has the meaning stated in § 1-101 of the Transportation Article.\n(b) Except for an emergency project, the Department of Transportation, including the Office of the Secretary and the modal administrations, may not use an appropriation for a major capital project for any capital project that was not included in the Consolidated Transportation Program when the appropriation was made.","path":["Article - State Finance and Procurement"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsf\u0026section=7-238","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:48Z","sha256":"abdcda8e69d35291faf847124445563cd0eff1f5927d988d3f350799055a3963","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-finance-and-procurement-7-237","next":"us-md/md.-code-state-finance-and-procurement-7-239"},"notice":"GroundRules: Original legal text.
