Code, State Government § 12–103.3","heading":"","body":"(a) (1) In this section the following words have the meanings indicated.\n(2) “Detention center function” includes:\n(i) operating and administering a detention center; and\n(ii) supervising personnel who perform a function described in item (i) of this paragraph.\n(3) “Law enforcement function” includes:\n(i) conducting patrol;\n(ii) making stops and arrests;\n(iii) investigating criminal offenses; and\n(iv) supervising personnel who perform a function described in items (i) through (iii) of this paragraph.\n(4) “Tort claim” means a tort claim filed in State court against a sheriff, a deputy sheriff, or the State claiming tortious conduct by a sheriff or a deputy sheriff arising out of activities related to the performance of a law enforcement function or a detention center function.\n(b) (1) A tort claim shall be considered defended, settled, and paid in the same manner as any other claim filed against a county.\n(2) (i) The State is the proper defendant in a tort claim.\n(ii) The county may not be named as a defendant in a tort claim.\n(c) Liability for a tort claim may not exceed the State’s waiver of immunity under § 12–104 of this subtitle.\n(d) (1) The State Treasurer is not liable under § 9–107 of the State Finance and Procurement Article for a tort claim.\n(2) The duties, responsibilities, and liabilities of the State under this subtitle for a tort claim shall be assumed by the applicable county.","path":["Article - State Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsg\u0026section=12-103.3","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:58Z","sha256":"8e74d56809b3d9a991c9f3f9b00c9b2f48223bd10146876d4be7654d298756f0","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-government-12-103.2","next":"us-md/md.-code-state-government-12-104"},"notice":"GroundRules: Original legal text.
