Code, State Government § 6.5–303","heading":"","body":"In determining whether to approve an acquisition of a nonprofit health service plan or a nonprofit health maintenance organization, the Administration shall consider:\n(1) the criteria listed in § 6.5–301 of this subtitle; and\n(2) whether the acquisition:\n(i) is equitable to enrollees, insureds, shareholders, and certificate holders, if any, of the transferor;\n(ii) is in compliance with Title 2, Subtitle 6 of the Corporations and Associations Article; and\n(iii) ensures that the transferee will possess surplus in an amount sufficient to:\n1. comply with the surplus required under law; and\n2. provide for the security of the transferee’s certificate holders and policyholders.","path":["Article - State Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsg\u0026section=6.5-303","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:58Z","sha256":"8b196bc1746287db2a4b3e89b1756070fd64547899495cf025ced872d2062849","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-government-6.5-302","next":"us-md/md.-code-state-government-6.5-304"},"notice":"GroundRules: Original legal text.
