Code, State Government § 9–112.1","heading":"","body":"(a) In this section, “Central Repository” means the Criminal Justice Information System Central Repository of the Department of Public Safety and Correctional Services.\n(b) The Agency shall apply to the Central Repository for a State and national criminal history records check for each new applicant for a license under § 9–113 of this subtitle.\n(c) The Director may require any applicant seeking a change of ownership or renewal of a license to submit fingerprints to the Central Repository for a State and national criminal history records check.\n(d) The Central Repository shall provide to the Agency:\n(1) the State and national criminal history records of each individual requiring a criminal history records check under subsection (b) of this section and issue a printed statement of the Federal Bureau of Investigation report;\n(2) an update of the initial criminal history records check for an individual requiring a criminal history records check and issue a revised printed statement of the Federal Bureau of Investigation report listing any criminal charge occurring after the date of the initial criminal history records check; and\n(3) an acknowledged receipt of the application for a criminal history records check by an individual requiring a criminal history records check.\n(e) As part of the application for a criminal history records check, the Agency shall submit to the Central Repository:\n(1) a complete set of the applicant’s legible fingerprints taken on forms approved by the Director of the Central Repository and the Director of the Federal Bureau of Investigation;\n(2) the fee authorized in § 10–221(b)(7) of the Criminal Procedure Article for access to Maryland criminal history records; and\n(3) the mandatory processing fee required by the Federal Bureau of Investigation for a national criminal history records check.\n(f) (1) In accordance with §§ 10–201 through 10–234 of the Criminal Procedure Article, the Central Repository shall forward to the applicant and the Agency a printed statement of the applicant’s criminal history record information.\n(2) Nothing in paragraph (1) of this subsection shall preclude the Director from notifying a licensed agent or an applicant of the approval or disqualification based on information obtained by the Agency under this section.\n(g) Information obtained from the Central Repository under this section:\n(1) shall be confidential;\n(2) may not be redisseminated; and\n(3) may be used only in connection with the issuance of a license required under this subtitle.\n(h) The subject of a criminal history records check under this section may contest the contents of the printed statement issued by the Central Repository as provided in § 10–223 of the Criminal Procedure Article.","path":["Article - State Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsg\u0026section=9-112.1","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:00:58Z","sha256":"917762e340ae970bcda8880c08217cf42eb9277c7378addd099a4a7124214c71","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-government-9-112","next":"us-md/md.-code-state-government-9-113"},"notice":"GroundRules: Original legal text.
