Code, State Personnel and Pensions § 11–302","heading":"","body":"(a) An employee is separated from State service when the appropriation in the State budget for the position is:\n(1) omitted by the Governor, as evidenced in the supporting documentation submitted with the budget;\n(2) struck by the General Assembly, as evidenced in the budget bill or in the report of the budget committees; or\n(3) reduced by the Governor in accordance with § 7-213 of the State Finance and Procurement Article, as evidenced in the supporting documentation submitted to the Board of Public Works.\n(b) An employee may not appeal a separation from employment under this section.\n(c) An employee who is separated under this section is not subject to the layoff provisions of Subtitle 2 of this title with the exception that an employee who is separated shall have the same reinstatement rights as a laid-off employee.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=11-302","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"d6895883414a3ed479df0de9f460803502b56010a9755e5332a61f52cf66178b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-11-301","next":"us-md/md.-code-state-personnel-and-pensions-11-303"},"notice":"GroundRules: Original legal text.
