Code, State Personnel and Pensions § 11–305","heading":"","body":"(a) (1) This section applies only to an employee who is in a position:\n(i) under a special appointment;\n(ii) in the management service; or\n(iii) in the executive service.\n(2) This section does not apply to a health officer appointed under § 3–302 of the Health – General Article.\n(b) Each employee subject to this section:\n(1) serves at the pleasure of the employee’s appointing authority; and\n(2) may be terminated from employment for any reason that is not illegal or unconstitutional, solely in the discretion of the appointing authority.\n(c) A management service employee or a special appointment employee designated by the Secretary under § 4–201(c)(2)(i) of this article may not be terminated for the purpose of creating a new position for another individual’s appointment because of that individual’s political affiliation, belief, or opinion.\n(d) An employee or an employee’s representative may file a written appeal of an employment termination under this section as described under § 11–113 of this title.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=11-305","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"db5e1c1e941e6c93c63e3bd6d215d9a22e76ebbecf975c5df8d87d08b9af0645","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-11-304","next":"us-md/md.-code-state-personnel-and-pensions-11-306"},"notice":"GroundRules: Original legal text.
