Code, State Personnel and Pensions § 13–101","heading":"","body":"(a) In this title, “contractual employee” means an individual:\n(1) who, under a written agreement, provides temporary personal services to the State for pay;\n(2) who is not employed in a budgeted position; and\n(3) who has an employer-employee relationship with the State in which the State:\n(i) furnishes necessary tools and a place to work;\n(ii) has the right to control and direct the details, means, and results of the performance of the services; and\n(iii) has the right to discharge the individual from employment.\n(b) “Contractual employee” does not include an individual who is employed as:\n(1) an employee in the:\n(i) skilled service;\n(ii) professional service;\n(iii) management service; or\n(iv) executive service; or\n(2) an emergency employee.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=13-101","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"126bd431bda74e1c8343b66bd70b5f3dd1d1bd72c575516ed6389958fe2edf27","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-12-405","next":"us-md/md.-code-state-personnel-and-pensions-13-201"},"notice":"GroundRules: Original legal text.
