Code, State Personnel and Pensions § 2–601","heading":"","body":"(a) Except as provided for in subsection (c)(2) of this section, a former nontemporary State employee who returns to State employment in a position in the State Personnel Management System within 3 years from separation is reinstated.\n(b) A reinstated State employee shall have unused accumulated sick leave restored.\n(c) (1) A former nontemporary employee who is reinstated in a position in the State Personnel Management System shall receive credit for time employed before separation for the purpose of determining the employee's:\n(i) step in the pay grade applicable to the employee's class;\n(ii) rate of annual leave accrual; and\n(iii) seniority rights.\n(2) A former nontemporary State employee who returns to a position in an independent personnel system in accordance with the reinstatement provisions of that system shall receive benefits allowed by that personnel system.","path":["Article - State Personnel and Pensions"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gsp\u0026section=2-601","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T20:01:07Z","sha256":"1c718e4dc3688007d01ddb66ddf1784283000449fd596c15a12187a88f6c24c2","source_id":"us-md","stale":false,"prev":"us-md/md.-code-state-personnel-and-pensions-2-517","next":"us-md/md.-code-state-personnel-and-pensions-2-701"},"notice":"GroundRules: Original legal text.
